These Terms of Service (“Terms”) govern your access to and use of TripFund's website and services (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use TripFund. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.
2. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
3. Trip Creation
Organizers may create trips, set budgets, invite travelers, and configure payment plans. Organizers are responsible for the accuracy of trip details and for coordinating with travelers and any third-party travel suppliers.
4. Payment Terms
Payments, deposits, and installments are processed through our payment processor, Stripe. By making a payment, you authorize the applicable charge. TripFund facilitates the collection of group payments but is not the travel supplier and does not provide travel services. Amounts collected are applied toward the trip as configured by the organizer.
5. User Responsibilities
- Provide accurate and complete information.
- Use the Service only for lawful purposes.
- Honor the payment commitments you make through the Service.
- Respect the rights and privacy of other users.
6. Prohibited Conduct
You agree not to misuse the Service, including by attempting to defraud others, circumventing security, uploading malicious code, scraping data, infringing intellectual property, or using the Service for money laundering or any unlawful activity.
7. Intellectual Property
The Service, including its software, design, logos, and content, is owned by TripFund and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
8. Limitation of Liability
To the maximum extent permitted by law, TripFund and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the amount of fees you paid to TripFund in the twelve months preceding the claim.
9. Disclaimer
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. TripFund does not warrant that the Service will be uninterrupted, error-free, or secure. TripFund is a payment coordination platform and is not responsible for the travel services provided by third-party suppliers.
10. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time.
11. Dispute Resolution
Most concerns can be resolved by contacting our support team. If a dispute cannot be resolved informally, you agree that disputes will be resolved on an individual basis, and you waive any right to participate in a class action, to the extent permitted by law.
12. Applicable Law
These Terms are governed by the laws of the United States and the State in which TripFund is organized, without regard to conflict-of-law principles.
